§ 1
Introductory provisions
This decree legally defines the term general maintenance and minor repairs related to the usage of the residential units.
§ 2
General maintenance
General maintenance is understood as maintenance and cleaning of the apartment, including equipment and furnishings, which are usually carried out during ongoing use of a residential unit. This particularly includes painting, plaster repairs, wallpapering, cleaning of floors including floor coverings, wall coverings, cleaning clogged drains up to vertical distribution systems. Furthermore, general maintenance includes keeping the equipment in working condition, regular check-ups and cleanings of the items specified in § 4 art. g), checking the functionality of the thermostats with electronic control, smoke detectors functionality check-ups including the exchange of power source, and inspection and maintenance of faucets with electronic control.
§ 3
Minor repairs
Minor repairs are understood as repairs of a residential unit and its internal equipment, if this equipment is part of the unit and it is in the lessor’s ownership, based on the subject specification or on the amount spent for the repair.
§ 4
Minor repairs based on the subject specification
Based on the subject specification the minor repairs are understood as
a) repairs of the surface parts of the floors, repairs of flooring (including thresholds and baseboard),
b) repairs of parts of doors, windows and their fittings, handles, locks exchange including the electronic opening of the entrance doors and repairs of their fittings, handles, roller blinds and curtains which are parts of the residential unit’s interior,
c) repairs and replacements of the distributional and terminal electrical appliances i.e. switches, sockets, circuit breakers, bells, internal phones, data network sockets, devices for analogue and digital TV signal, light source exchanges in the lighting systems, repairs of the devices for the satellite signal reception, repairs of audio-visual devices for the building entrance door opening and communication, repairs of the control units and switches for the ventilation system, air condition and central vacuum cleaning system, repairs of the electronic security systems and motion detectors,
d) exchange of the gas valves in the gas piping except the main gas switch for the unit,
e) repairs and exchanges of the connection parts at the water piping except the main switch for the unit, drain exchanges and fat collectors,
f) repairs and certifications of the unit meters as per the metrology law or devices for the distribution of the expenses for heating, repairs and certifications of the unit’s meters for hot and cold water, fire alarms and smoke detectors, repairs of heating systems and related systems for the regulation of the room’s temperature or systems allowing individual temperature regulation,
g) repairs of the water drains, smell locks, vapour extractors, extractor hoods, water taps, showers, water heating systems, bidets, sinks, tubs, dish sinks, flushers, stoves, ovens, boilers, infra emitters, kitchen furniture units, inbuilt and self-standing wardrobes,
h) repairs of the heaters for the solid fuels or gas and electricity, smoke pipes, storey heaters for electricity, gas and fluid fuels, related thermostats, regulators and fittings ; except the heaters and heat distribution systems for central heating,
i) replacements of the small parts of the subjects mentioned at the art. g) and h)
§ 5
Minor repairs based on the amount spent on the repair
The repairs based on the amount spent on the repair are understood as other repairs of the unit and its equipment, replacements of the specific subjects or their parts which are not specified in §4, if the expense for 1 specific repair doesn’t exceed amount of CZK 1.000. If more repairs are conducted on one same thing and these repairs are related to each other and they follow each other in time, then the sum of all expenses for such repairs is calculated as one expense. The costs for the transport and other extra charges are not counted as part of the repair expense and they are covered by the tenant separately.
§ 6
Annual expense limit
(1) If the sum of all expenses for minor repairs as specified in §4 and §5 exceeds in one calendar year amount equal to CZK 100 /m2 of the unit’s floor area, the other following repairs in the same calendar year are not considered to be minor repairs.
(2) The floor area of the unit for the purposes of this decree is understood as the sum of all floor areas of the unit and all spaces which are used together with the unit, and also those areas which are outside the unit, if they are used solely by the tenant; the floor areas of the cellars which are not rooms for living and floor areas of the balconies, loggias and terraces are calculated to the total sum only by their half.
